These Terms of Service (“Terms”) govern the purchase and use of services provided by That’s It Creative Hub Soc. Coop. A R.L, VAT / P.IVA 03797470782, an Italian company (“Company”, “we”, “us”, “our”), through the website booksbuddyus.com (the “Site”).

By placing an order or using our services, you (“Customer”, “you”) agree to be bound by these Terms.

1. Scope of Services

We provide custom digital services, including but not limited to:

Book cover design
Book interior formatting (Format Basic / Format Pro / Deluxe)
Amazon A+ Content
Low content books
Done-for-you book assets and related publishing services

All services are custom-made and created specifically based on the information, materials, and instructions provided by the Customer.

2. Ordering Process

An order is considered accepted once payment is successfully completed.

To begin the service, the Customer must provide all required materials (e.g. manuscript, trim size, brand assets, brief).
Delivery timelines start only after all required materials are received in complete and usable form.

Incomplete or delayed materials may pause the delivery timeline.

3. Delivery Timeline

Unless otherwise stated, services are delivered within 10 business days, guaranteed, calculated from receipt of complete materials.

Delivery is made digitally via email or secure download link.

If the Customer fails to respond, provide feedback, or approve drafts within a reasonable time, the timeline will be suspended until communication resumes.

4. Revisions

Each service includes a defined number of revisions, as specified on the relevant product page.

Revisions are limited to adjustments within the original scope.
Requests that change the original brief, concept, or structure may be treated as additional work and may require an extra fee.

5. Pricing, Payments, and Taxes

All prices are displayed in the currency shown on the Site and are exclusive of applicable taxes unless otherwise stated.

Payment must be made in full before work begins.

We reserve the right to update pricing at any time; changes do not affect confirmed orders.

6. Consumer Cancellation Rights (UK)

If you are a UK consumer, you generally have a 14-day cancellation right for distance contracts.

However, because our services are custom and made to your specifications:

By placing an order, you expressly request that we begin providing the service immediately.
You acknowledge that once the service is fully performed, you may lose your right to cancel.

If cancellation is requested after work has started but before completion, you may be charged proportionally for work already performed, as permitted by law.

7. Refund Policy (Summary)

Due to the custom nature of our services:

Refunds are not available for completed custom work.
No refunds are issued once files are delivered and the service is completed.
Exceptions may apply only in cases of non-delivery or material failure to provide the agreed service.

8. Intellectual Property & License

Unless otherwise stated:

All intellectual property rights in the delivered work are transferred to the Customer only after full payment.
If a refund is issued or a chargeback is successful, any license or right to use the delivered materials is immediately revoked.
In such cases, the Customer must cease all use, delete all files, and may not publish, distribute, or exploit the work in any form.

We retain the right to showcase non-confidential work for portfolio purposes unless otherwise agreed.

9. Customer Responsibilities

The Customer is responsible for:

Ensuring that all materials provided do not infringe third-party rights
Verifying compliance with platform rules (e.g. Amazon KDP)
Reviewing and approving deliverables before publication

We do not guarantee publishing approval by third-party platforms.

10. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed the amount paid for the relevant service.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy.

If you are a consumer, nothing in these Terms affects your mandatory rights under the laws of your country of residence.

Any disputes shall be subject to the competent courts, as permitted by applicable law.
